Gun deal ends in gunfire and death; man charged with murder

Arrest records show a man fired at the suspect, Mario Duarte, when Duarte allegedly pointed his own gun at him.

BEXAR COUNTY, Texas — A man has been charged with murder in connection with an April 12 gun deal in Boerne that ended in chaos, officials say. One man died after being taken to the hospital after the incident. 

It was after 8 p.m., arrest records say, when 20-year-old Mario Duarte and Martin Henderson met with two other men in the 8700 block of Starr Ranch to buy a Glock. One of those other men, Victor Hernandez, "became suspicious" when his friend was asked to get into a car, "so grabbed his personally owned Glock pistol from the middle console, charged it and placed it on his lap."

At one point, documents say, Duarte was seen pointing the weapon at one of the men's stomach, causing him to jump out of the car. Hernandez told Bexar County sheriff's deputies that Duarte than made "direct eye contact with him, lifting his arm to point the firearm at him." Hernandez told officials he responded by firing multiple times at Duarte. 

Hernandez told deputies he believed he shot both Duarte and Henderson, who was driving. As he and his friend left the seen, records state, Hernandez continued firing "due to fear of being shot at" before eventually stopping and calling 911. Henderson died the next day. 

Deputies obtained video footage from the apartment complex where the incident unfolded which reflected Hernandez's account. Duarte now faces charges of murder and aggravated robbery after authorities say he "committed an act clearly dangerous to human life that caused the death of Martin Henderson."

Duarte was also shot in the incident. He was previously released but is back in custody on another $100,000 bond after the murder charge was filed.
