DWI hearing rescheduled for City Councilman Marc Whyte

The council member remains suspended from committee assignments but can participate in City Council meetings.

SAN ANTONIO — A March hearing for District 10 City Councilman Marc Whyte, accused of driving while intoxicated after he was pulled over by San Antonio police officers in late December, has been rescheduled for the morning of May 14. 

It was originally set to happen Tuesday. Court officials confirmed the rescheduling to KENS 5. 

Whyte was taken into custody the night of Dec. 29 on the north side, when officials say he showed signs of intoxication. He was released the next day after posting bond, and later said he "did not feel intoxicated" when he drove home. 

"But that isn’t point," he went on to say. "Nobody should drive even if they have had just one drink. I take full ownership over my actions, and I apologize to the residents of District 10, my family, friends, counsel colleagues and anyone else who I have let down."

In January, City Council voted 10-0 to censure Whyte, formally stating its disapproval but allowing him to remain on the council. Mayor Ron Nirenberg, however, suspended Whyte from his committee assignments until further notice "or until more details of the incident are known." 

City officials said Monday that Whyte was still suspended. 

Driving while intoxicated carries a punishment of up to 180 days in jail and/or a fine of up to $2,000 for adults who are convicted. Those found guilty may also have their license suspended for two years.
