New Braunfels man arrested for possession of child porn

On August 12, police say Hermes Mendez went inside a women's restroom and took photos of an 11-year-old girl with his cell phone.

New Braunfels police say they have a predator in custody. Hermes Estuardo Mendez,36, is accused of taking pictures of an 11-year-old girl inside a Wal-Mart restroom.

Police also believe Mendez may have taken photos of an adult female, who they're trying to locate.

David Ferguson with the New Braunfels Police Department said that Mendez was a predator looking for an opportunity. According to police report, on August 12 Mendez went inside the women's restroom and took photos of an 11-year-old girl under the stall with his cell phone.

"He was taken to jail that night on outstanding warrants," Ferguson said.

New Braunfels police started an investigation and found more evidence on his cell phone.

"The male was in possession of a piece of child pornography, the victim being a 5-year-old girl," Ferguson noted.

During these months, investigators built a case.

"It was a matter of getting all the i's dotted and the t's crosses so to speak before they were able to get that arrest warrant signed," Ferguson said.

On November 1, an arrest warrant was issued for Mendez on a third degree felony charge of possession of child pornography. Investigators initially had a tough time tracking him down but arrested him on November 28 at his home.

Mendez is in the Comal County Jail. His bond is set at $200,000.

Police are looking for that adult female to come forward who was in the Wal-Mart on August 12 between 8 p.m. and 9 p.m. Additional charges may be filed.
