NEW BRAUNFELS -- New dash cam video reveals a police pursuit in New Braunfels that came to a deadly end, killing the driver who attempted to get away.

In the early morning hours of Feb. 10, dash cam video captures what would become the last 10 minutes in the life of 38-year-old Mark Anthony Saldivar.

The rate of speed he was going -- obviously we couldn t let him continue on, said Lt. Mike Penshorn with the New Braunfels Police Department.

At exactly 2:13 a.m., you can see what police say is Saldivar s red Ford Expedition zooming past a police unit. The officer begins to pursue the SUV traveling northbound on I-35 near Kohlenberg Road, and the Expedition continues to drive even faster.

At one point, the officer drives at 123 miles per hour to catch up to Saldivar.

He was showing obvious signs that the driver was intoxicated all over the roadway, cutting in and out of traffic, Penshorn said.

Police say they had no choice but to try and get Saldivar off the roadway.

In this situation, although there were other vehicles, it was minimum hazard to the public and us continuing it, and that outweighed us letting him go on in traffic, Penshorn said.

For nine minutes the chase went on.

The video shows the SUV exiting the highway, passing up stop signs and cutting through neighborhoods.

Saldivar slows down for a while but speeds reach a 100 miles per hour once again.

Meanwhile, a Comal County Sheriff s unit is also in pursuit. Police say other officers were working on setting up spikes to stop the SUV.

The driver was intoxicated. He was definitely a danger to the public, Penshorn said. We were doing whatever we could to end it as quickly as possible.

At 2:22 a.m., It all came to an end in the 1500 block of I-35 southbound Frontage Road.

Police say Saldivar lost control of his vehicle and crashed. He was ejected through the windshield landing in a parking lot in front of the Honda dealership.

Police say Saldivar was highly intoxicated with blood alcohol level three times the legal limit.
