SAN ANTONIO - A young mother was sentenced to 20 years in prison for the death of her 3-year-old son. The family of Janie Altamirano did not want to speak on camera but their emotion in court expressed exactly how they felt.
As 25-year-old Janie Altamirano was escorted to prison her family could be heard crying in the court room.
Judge Angus McGinty denied her request for deferred adjudication and sentenced her to 20 years in prison for the death of her 3-year-old son Ethan Altamirano. It was exactly what the prosecuting attorney was hoping for.
In looking at everything this child led a short life full of injuries, said Jane Ischy-Prins, prosecutor.
It was on December 6, 2010, Ethan was unresponsive and had been sick for a couple days. The medical examiner later ruled he died from blunt force trauma.
An autopsy report said he was hit on his stomach with enough force to cause his internal organs to hit his spinal column. The report said that led to an infection in his stomach causing his death.
She thought it was a stomach flu (and said) 'I'll take him to the doctor Monday morning', said defense lawyer Robert Behrens.
The defense lawyer said Altamirano did not know the gravity of the situation. He said previous evidence suggests her boyfriend at the time, Michael Pastran, was the one who may have injured Ethan.
Pastran was arrested soon after the incident in 2010, but after an investigation the charges were dropped.
We see these situations sometimes and it breaks your heart when you see them, said the defense attorney.
