Homeowner shoots intruder climbing his fence, police say

SAN ANTONIO - A man in San Antonio’s Medical Center was forced to protect his home from an intruder Wednesday morning. San Antonio Police may hold the 57-year-old homeowner criminally responsible in the shooting.

"He  is listed as a suspect," Officer Doug Greene said.

The incident happened around 3:30 a.m. in the 4400 block of Cliff oaks when police said a homeowner shot a man trying to leave his property by climbing a fence.

Police said the homeowner heard a noise and went to investigate. He armed himself and shot Toby Synder in the leg.

Synder, 47, was taken to University Hospital with an injury that was not critical.

The homeowner who was in the house with his wife could face charges of aggravated assault with a deadly weapon. The shooting is still under investigation. Synder is not expected to face charges. Police have listed him as a victim.

Police on the scene said this is not the first time this same owner has confronted an intruder in his yard. Officers said other homeowners in this gated community have faced similar intrusions.
