Viola Barrios' murder trial headed to Victoria, TX

Update:  The case will be tried in Victoria, TX beginning Jan. 8, 2010.
 

Joe Estrada has been granted a change of venue. His lawyers say media attention on the case will not allow Estrada to get a fair trial in San Antonio. But it will be another day before a location for the trial is set.

Estrada stands accused of shooting 76-year-old Viola Barrios in her northwest-side home in April, 2008.

Tuesday a full series of pre-trial hearings were held to discuss a number of issues in the case.

Last month Estrada's attorneys successfully argued that even with Bexar County's jury pool of more than a million people, a panel of twelve, who had not been influenced by pre-trial coverage, could not be found.

The judge heard arguments on a number of issues, including the reported confession Estrada made to police.

Hearings resume next Thursday in the 186th District Court. A new location could be settled by then.
