What started out as an undercover drug bust at a home in south Bexar County ended in a deadly crash along I-35 when a fleeing suspect's car slammed into a car carrying a family of six.
A 3-year-old boy was killed in the crash and four of his family members were clinging to life at University Hospital on Thursday morning.
According to the Bexar County Medical Examiner, the boy killed was Walter Maspero.
His mother, father, and two younger siblings -- a one-year-old and newborn -- were in critical condition. One other child was not injured.
The suspect, 30-year-old David Rodriguez, was in stable condition Thursday morning.
Police said Rodriguez is being charged with capital murder. He was expected to be taken to the Bexar County jail once discharged from the hospital.
Police said they were stopping people leaving a home suspected of drug activity when the driver of a black suburban refused to stop.
As police chased the fleeing suspect along I-35 near Shepard Road, he turned around and tried to head north, slamming head-on into the Volvo carrying the Maspero family.
Investigators said the SUV that Rodriguez was driving was filled with hundreds of pounds of marijuana. Rodriguez could also be facing federal drug charges. Bond has been set at $2 million.
