The first lawsuit has been filed against the homebuilder of the Hills of Rivermist neighborhood.
The first lawsuit against Centex and Pulte Homes comes from Luis and Janice Jimenez, who are among those who have been evacuated from their homes.
They allege in their lawsuit that shoddy construction led to the retaining wall failure and their home being seriously damaged.
The couple and their lawyers were to speak more about the lawsuit later Friday.
