SAPD: Theft suspect run over by driver who wanted his cell phone back

San Antonio police said a man who caught a thief in the act stopped him by running him over with his SUV.

The incident happend around 3 a.m. Monday on the corner of Hudson and Lamar on the city's east side.

Investigators said a man walked past an SUV parked near an apartment complex and stole a cell phone from the front seat.

The owner saw the alleged thief and got in his SUV, then ran over the man with his vehicle.

The suspect suffered a broken leg and was taken to University Hospital.

The SUV driver claimed he used a bat, not his vehicle, to take the suspect down. Police said the evidence showed otherwise.

Police said the driver will not face charges since he was defending his property at night.
