A group of adult entertainment clubs hopes to strip the city of San Antonio of its current human display ordinance. A trial court ruled in San Antonio's favor.
The two were scheduled to meet in the Fourth Court of Appeals on Tuesday to face off over the issue.
At issue is San Antonio's human display ordinance, which makes it illegal to dance fully nude or partially nude in public places. The ordinance also requires human display permits. The city statute was adopted in 2005.
San Antonio police said they were enforcing that law when they raided the Paradise Gentlemen's Club and the XTC Caberet in December 2009. Eight men and four women were arrested in the sting.
Investigators said they found unlawful nudity. Among the arrested were adult entertainers and some managers from the clubs on charges of violating the human display ordinance. One woman was also reportedly picked up on a prostitution charge.
That raid was the subject of lawsuits by the clubs, which were consolidated into Tuesday's courtroom argument. The gentlemens' clubs think the city's ordinance is far-reaching and violates their constitutional rights.
