Mike Hearn, an attorney who specializes in construction defect litigation, says the retaining wall at Rivermist can be fixed and the homes can be livable again. However, that could require a lot of patience and a lot of paying.
“We have handled a lot of these cases and found the design is largely the problem as far as wall is concerned.” said Hearn.
The McKenzie, Rhody, and Hearn law firm will hold an informational meeting on Sunday for residents on the history of the retaining walls construction and the legal process that lies ahead. The design of the wall will be scrutinized, but Hearn says residents who want to stay in their homes may have a chance to do so one day, possibly after litigation.
“It is definitely fixable. I have not seen a wall failure yet that cannot be fixed. It is just a matter of money it will take.”
