Accident survivor asks why police officer didn't help

Maria Elena Rodriguez survived a crash along 1604, between Stone Oak Parkway and Highway 281, her longtime friend Rosita Davila was killed in the accident.

It happened on Sunday just after midnight.

Sgt. Gabe Trevino was in the other vehicle and was not injured. He's the former spokesperson for SAPD and a 21-year veteran of the force.

He could not be reached for comment.

Rodriguez questions why the off-duty sergeant involved in the accident didn't rush to help them. 

 "Why didn't he at least go help us," asked Rodriguez. "He should have been there to help us, but there was nobody there."

James Mazuca, attorney for Rodriguez, said any possible evidence for a criminal case was lost the morning of the accident.

"The only recourse is a civil lawsuit because in my opinion the criminal investigation was botched, because the evidence was able to walk away:  The blood of Sergeant Trevino was never drawn," said Mazuca.

The S.A.P.D. said the accident is still under investigation.
