SAN ANTONIO – If you were planning on seeing Kevin Gates perform at Mala Luna Music Festival this coming weekend, we have bad news for you.

On Wednesday, 30-year-old Gates was found guilty to battery in Polk County Florida after he was seen kicking a female fan during a concert there last year, Billboard reported.

The judge sentenced Gates to 180 days in Polk County Jail along with credit for any time previously served. According to Billboard, he was convicted by a jury of six women after one day of testimony.

In a report from BET, Gates pleaded not guilty and instead simply defended himself against an aggressive fan under Florida’s “Stand Your Ground Law.” Gates claimed he was the victim when 18-year-old Miranda Dixon tried to pull him off the stage.

Gates’ attorney Jose Baez went as far as to claim Gates’ foot never touched Dixon; that she was just trying to gain damages in an upcoming civil trial, BET reported.

Although he’s listed as a headliner, Gates most likely will not be making the festival.

On the Mala Luna lineup, Gates is scheduled to perform on Sunday. As of Thursday, he’s still listed as performing on the festival's website.

Due to his sentence, Gates will possibly still be in jail.
